GENERAL LIABILITY WAIVER AND RELEASE OF LIABILITY

THIS IS A LEGAL DOCUMENT. PLEASE READ CAREFULLY BEFORE SIGNING.

1.     ACKNOWLEDGMENT OF RISKS

I, the undersigned, acknowledge that I am voluntarily participating in grappling, Brazilian

Jiu-Jitsu, and other martial arts classes, training, and related activities at [305 Grappling, LLC](“the Academy”) in Miami, Florida. I understand that these activities are inherently dangerous and involve the risk of serious injury, including but not limited to, bruises, cuts, sprains, strains, fractures, dislocations, head injuries, concussions, and in extreme cases, permanent disability or death. I also acknowledge that such injuries may result not only from my actions but also from the actions, omissions, or negligence of others, including but not limited to other participants, instructors, and employees of the Academy.

2.     ASSUMPTION OF RISK

I understand the nature of grappling and martial arts activities, and I am aware of my own physical condition and capabilities. I believe I am in good health and have no physical or mental limitations that would preclude my safe participation in these activities. I knowingly and voluntarily assume all risks associated with my participation, including, but not limited to, the risks of injury, illness, or death, whether caused by my own actions or the actions of others.

3.     RELEASE AND WAIVER OF LIABILITY

In consideration of being allowed to participate in any way in the programs, classes, or activities at the Academy, I hereby release, waive, discharge, and covenant not to sue the Academy, its owners, officers, employees, instructors, agents, and all other participants from any and all liability, claims, demands, actions, or causes of action whatsoever, arising out of or related to any loss, damage, injury, or death that may be sustained by me, or any property belonging to me, whether caused by the negligence of the Academy, its owners, officers, employees, instructors, agents, or otherwise, while participating in any activity or while in, on, or upon the premises where the activities are being conducted.

4.     INDEMNIFICATION AND HOLD HARMLESS

I agree to indemnify and hold harmless the Academy, its owners, officers, employees, instructors, agents, and all other participants from any loss, liability, damage, or cost they may incur due to my participation in any activities, whether caused by the negligence of the Academy or otherwise.

5.     MEDICAL RELEASE

I understand and agree that the Academy does not provide medical or health insurance coverage for participants. In the event of an emergency, I authorize the Academy and its representatives to obtain medical treatment for me, if necessary. I agree to assume full financial responsibility for any medical expenses incurred.

6.     MEDIA RELEASE

I consent to the use of my image, likeness, or voice in photographs, videos, or other media by the Academy for promotional, marketing, or educational purposes without compensation.

7.     ARBITRATION AGREEMENT

I agree that any dispute, claim, or controversy arising out of or relating to this waiver, my participation in activities at the Academy, or any other agreement between myself and the Academy, including any claims of personal injury or death, shall be resolved exclusively through final and binding arbitration, rather than in court, in accordance with the rules of the American Arbitration Association (AAA). The arbitration will be conducted in Miami, Florida. I understand that, by agreeing to this provision, I am waiving my right to a trial by jury or to participate in a class action.

8.     SEVERABILITY

If any provision of this waiver and release is found to be unenforceable or invalid, the remainder of the waiver and release shall remain in full force and effect.

9.     ACKNOWLEDGMENT OF UNDERSTANDING

I have read this waiver and release of liability, fully understood its terms, and understood that I am giving up substantial rights, including my right to sue. I acknowledge that I am signing the agreement freely and voluntarily and intend by my signature to be a complete and unconditional release of all liability to the greatest extent allowed by law.
